Judge Grants Timothy Busfield Release Pending Trial — Melissa Gilbert Responds in Court

The courtroom was tense as the judge reviewed arguments that could determine what happens next for actor and director Timothy Busfield. Known for memorable roles in Thirtysomething and The West Wing, Busfield has been at the center of major legal headlines in recent weeks. This week, a judge in Bernalillo County ruled that he could be released from a New Mexico detention facility while he awaits trial, allowing him to return home under court supervision. The decision reversed an earlier move that had kept him in custody without bond, instantly drawing strong public attention as the case continues to unfold.

Busfield is facing serious accusations connected to claims involving minor cast members during production of the TV drama The Cleaning Lady, which was filmed in New Mexico. Authorities have filed charges that include two counts of criminal sexual contact of a minor and one count of child abuse. Busfield has denied the allegations and has stated through his position in the case that he intends to fight the charges as the legal process moves forward. As with all ongoing cases, the allegations remain unproven in court at this stage.

During the pretrial detention hearing, Judge David Murphy heard both sides present their arguments. Prosecutors pushed for continued detention, pointing to the gravity of the accusations, while the defense argued that Busfield should be released under controlled conditions. The judge stated that the evidence presented at this stage appeared “neutral” and also noted Busfield’s lack of a prior criminal record. Based on those factors, the court determined that he could be released under supervision, with strict conditions designed to reduce any risk while proceedings continue.

The hearing was emotional for Busfield’s family, with actress Melissa Gilbert, his wife, attending in person and reacting visibly after the ruling. Supporters submitted letters to the court vouching for his character, and Gilbert has publicly expressed concern for his wellbeing while the case progresses. Under the court’s release terms, Busfield must comply with pretrial supervision requirements, follow all court restrictions, and avoid unsupervised contact with minors. A preliminary hearing is scheduled next, where the court will further consider whether the case has enough evidence to proceed toward trial.
